Η στοιχειώδης ευθιξία επιβάλλει παραιτήσεις
Κι ενώ το Υπουργικό Συμβούλιο εξέφρασε την πρόθεση διορισμού ανεξάρτητου ποινικού ανακριτή (ορθώς, ελπίζοντας το άτομο που θα επιλεγεί να είναι άξιο να φέρει εις πέρας αυτό το πολύ σημαντικό έργο) για να διερευνήσει τα σοβαρότατα εγκλήματα που αποδίδονται στον Νίκο Αναστασιάδη και άλλα πρόσωπα στο πόρισμα της Αρχής κατά της Διαφθοράς, ο Γενικός Εισαγγελέας κι ο βοηθός του επιδίδονται σε ρεσιτάλ παραλογισμού και ανορθολογισμού.
Ενώ εξέφρασαν την πρόθεση τους να αυτοεξαιρεθούν από την υπόθεση, εντούτοις στην ίδια ανακοίνωση ανέφεραν ότι η εξέταση της θα ανατεθεί σε Εισαγγελικό Συμβούλιο αποτελούμενο από υφιστάμενους τους. Αυτό είναι εμπαιγμός της νοημοσύνης μας.
Πώς είναι δυνατό να κωλύεται ο προϊστάμενος αλλά ο υφιστάμενος του να μην έχει πρόβλημα να ασχοληθεί με την υπόθεση;Για το Volt, είναι αυτονόητο ότι, τόσο οι ανακρίσεις, όσο και ο χειρισμός των ποινικών διώξεων που θα προκύψουν, πρέπει να ανατεθεί σε ανεξάρτητους νομικούς που να μην έχουν καμιά σχέση υπαγωγής με το Γενικό Εισαγγελέα, ο οποίος – κατά παραδοχή του – δεν πληροί τα εχέγγυα της αμεροληψίας για να δικάσει τον στενό του φίλο, Νίκο Αναστασιάδη, τον οποίο έχει υπηρετήσει (όπως κι ο βοηθός του) ως υπουργός.
Η ανάθεση σοβαρών υποθέσεων σε ιδιώτες δεν είναι πρωτοφανής, αντιθέτως έχει εφαρμοστεί με επιτυχία σε ευαίσθητες υποθέσεις στο παρελθόν. Ασφαλώς, αν οι κ.κ. Σαββίδης και Αγγελίδης είχαν τη στοιχειώδη ευθιξία, θα είχαν υποβάλει την παραίτηση τους, όχι μόνο επειδή όφειλαν οι ίδιοι να είχαν εντοπίσει, διερευνήσει και διώξει τα σοβαρότατα αδικήματα που αναφέρονται στο πόρισμα, αλλά κι επειδή καταλογίζονται σοβαρές ποινικές ευθύνες σε πρόσωπο το οποίο ήταν άμεσα υφιστάμενο τους και λογοδοτούσε στους ίδιους.

And while the Council of Ministers expressed its intention to appoint an independent criminal investigator (rightly so, in the hope that the person selected will be worthy of carrying out this very important task) to investigate the very serious crimes attributed to Nicos Anastasiades and other individuals in the report of the Anti-Corruption Authority, the Attorney General and his deputy are engaging in a recital of absurdity and irrationality.
While they expressed their intention to recuse themselves from the case, in the same announcement they stated that its examination would be assigned to a Prosecutorial Council composed of their subordinates. This is an insult to our intelligence.
How is it possible for the head of the service to have a conflict of interest, but for their subordinate to have no problem dealing with the case? For Volt, it is self-evident that both the investigations and the handling of any criminal prosecutions that may arise must be assigned to independent legal professionals who have no hierarchical relationship with the Attorney General, who – by his own admission – does not meet the guarantees of impartiality required to judge his close friend, Nicos Anastasiades, whom he has served (as has his deputy) as a minister.
The assignment of serious cases to private individuals is not unprecedented; on the contrary, it has been successfully applied in sensitive cases in the past. Certainly, if Messrs. Savvides and Angelides had even a basic sense of propriety, they would have submitted their resignations, not only because they should themselves have identified, investigated, and prosecuted the very serious offences referred to in the report, but also because serious criminal responsibilities are attributed to a person who was directly subordinate to them and accountable to them.
