Η μεταρρύθμιση της Νομικής Υπηρεσίας παραμένει μετέωρη, με ανοικτά ζητήματα τόσο στον διαχωρισμό των αρμοδιοτήτων του Γενικού Εισαγγελέα όσο και στον έλεγχο των αποφάσεών του για μη άσκηση ή διακοπή ποινικών διώξεων. Η βραδύτητα στην απονομή της δικαιοσύνης, οι αδικαιολόγητες καθυστερήσεις στη δημιουργία ανεξάρτητης υπηρεσίας δικαστηρίων και τα προβλήματα στην εκτέλεση των δικαστικών αποφάσεων πλήττουν την αποτελεσματικότητα του δικαστικού συστήματος.
Κάτω από το μικροσκόπιο της Επιτροπής Θεσμών της Βουλής θα τεθεί προς εξέταση, την ερχόμενη Τετάρτη, η πρόσφατη έκθεση της Ευρωπαϊκής Επιτροπής (Κομισιόν) για το κράτος δικαίου στην Κύπρο. Στόχος, η διαπίστωση των κακώς εχόντων και η αντιμετώπισή τους. Η έκθεση δημοσιεύθηκε στις 17 Ιουλίου 2026 και καταγράφει πρόοδο σε σειρά θεσμικών και νομοθετικών μεταρρυθμίσεων. Διαπιστώνει, ωστόσο, ότι δύο από τα σημαντικότερα κεφάλαια που αφορούν το κράτος δικαίου εξακολουθούν να παρουσιάζουν σοβαρές εκκρεμότητες και καθυστερήσεις. Πρόκειται για τη μεταρρύθμιση της Νομικής Υπηρεσίας και την αποτελεσματικότητα στην απονομή της δικαιοσύνης. Τα νομοθετικά μέτρα που αποφασίστηκαν, καθώς και άλλα που προωθήθηκαν στη Βουλή, παραμένουν για μεγάλο χρονικό διάστημα σε εκκρεμότητα. Έμειναν, όπως θα λέγαμε στην καθομιλουμένη, «μεσοδότζιν», με το κράτος δικαίου να βρίσκεται σε κατάσταση… αναμονής. Στο μικροσκόπιο της Κομισιόν βρίσκονται, παράλληλα, η αποτελεσματικότητα της ανεξάρτητης Αρχής κατά της Διαφθοράς, η σύσταση ανεξάρτητης υπηρεσίας δικαστηρίων που παραμένει στα χαρτιά, η εκτέλεση δικαστικών αποφάσεων που δεν εφαρμόζονται από κρατικές υπηρεσίες, καθώς και ζητήματα που αφορούν τη διαφάνεια.

The Rule of Law Left in Limbo – Yellow Card from the European Commission Calling for Reform Bills to Be Passed
The reform of the Law Office remains in limbo, with outstanding issues concerning both the separation of the powers of the Attorney General and the oversight of decisions not to initiate or to discontinue criminal proceedings. Delays in the administration of justice, unjustified delays in establishing an independent court administration service, and problems with the enforcement of court decisions are undermining the effectiveness of the judicial system.
The recent European Commission report on the rule of law in Cyprus will come under the scrutiny of the House of Representatives’ Institutions Committee next Wednesday. The aim is to identify shortcomings and address them. The report was published on July 17, 2026, and records progress in a number of institutional and legislative reforms. It finds, however, that two of the most important areas concerning the rule of law continue to face serious outstanding issues and delays. These concern the reform of the Law Office and the effectiveness of the administration of justice.
The legislative measures that have been agreed, as well as other measures submitted to Parliament, have remained pending for a considerable period of time. In colloquial terms, they have been left “in limbo,” leaving the rule of law in a state of… waiting.
At the same time, the European Commission is closely examining the effectiveness of the Independent Anti-Corruption Authority, the establishment of an independent court administration service, which remains on paper, the enforcement of court decisions that are not being implemented by state services, as well as issues relating to transparency.
