Η προδιαγεγραμμένη μάχη της οικογένειας του Θανάση Νικολάου, που επιζητεί δικαίωση σε σχέση με τις συνθήκες του τραγικού θανάτου του 26χρονου εθνοφρουρού στις 29/09/2005 μοιραία φέρνει στο προσκήνιο γνωστές και άγνωστες πτυχές της όλης υπόθεσης.
Η οικογένεια του θανόντα έχει εκδηλώσει την πρόθεση της να ασκήσει ιδιωτικές ποινικές διώξεις σε βάρος επτά προσώπων (σ.σ. νέοτερες πληροφορίες αναφέρουν ότι ίσως ο αριθμός να αυξηθεί), οι οποίες θα καταχωρισθούν μέχρι το τέλος της προσεχούς εβδομάδας. Κι αυτό σύμφωνα με τον χρονικό ορίζοντα που έθεσε ο δικηγόρος της οικογένειας, Νίκος Κληρίδης, μιλώντας πρόσφατα στο Κυπριακό Πρακτορείο Ειδήσεων.
Ο «Φ» στην προσπάθεια του να ανοίξει το φάκελο «Θανάσης Νικολάου» υπό το πρίσμα των τελευταίων δεδομένων, έγινε δέκτης θέσεων περί μιας μάχης που δεν θα φέρει μόνο νομικούς κύκλους σε σύγκρουση, αλλά ακόμα και μέλη της ιατρικής επιστήμης.
Σε τουλάχιστον δυο περιπτώσεις ανεξάρτητες πηγές πληροφόρησης μας υπέδειξαν το υπόμνημα του Ιατροδικαστή – Παθολογοανατόμου, δρα Ανδρέα Μαρνερίδη. Ταυτόχρονα, μας αναφέρθηκε πως η γνωμάτευσή του τελευταίου επί των αιτιών θανάτου καθόρισε τη στάση της Εισαγγελίας στην επεισοδιακή τρίτη θανατική ανάκριση.
Πρόκειται για ένα υπόμνημα, το οποίο είχε καταθέσει ως τεκμήριο «Α» προς αναγνώριση στην θανατική ανάκριση (10/5/2024 το πόρισμα) η εκπρόσωπος του Γενικού Εισαγγελέα.
Πιο συγκεκριμένα, κατατέθηκε στο πλαίσιο του αιτήματός (6/12/2023) της ανώτερης δημόσιας κατηγόρου, Ξένιας Ξενοφώντος, ώστε να δώσει ενόρκως μαρτυρία ο δρ Μαρνερίδης. Εν τέλει η θανατική ανακρίτρια Ντόρια Βαρωσιώτου με απόφασή της (8/12/2023) απέρριψε το εν λόγω αίτημα.
Χάσμα απόψεων
Το υπόμνημα φανερώνει το χάσμα απόψεων μεταξύ μελών της ιατρικής επιστήμης για τα αίτια θανάτου του Θανάση Νικολάου και είναι ενδεικτικό και της γραμμής που θα ακολουθηθεί από την υπεράσπιση, νοουμένου ότι οι ιδιωτικές ποινικές διώξεις ασκηθούν, δεν ανασταλούν και περάσουν το στάδιο του εκ πρώτης όψεως.
Ο «Φ» το δημοσιοποιεί σήμερα εκτελώντας την αποστολή του να φέρνει στο φως γεγονότα, προσθέτοντας στη δημόσια συζήτηση κι εξυπηρετώντας το δημόσιο συμφέρον, χωρίς στην προκειμένη να παραγνωρίζει τα δικαιώματα της οικογένειας του αδικοχαμένου και το έργο όλων όσοι δούλεψαν για να λυθεί το μυστήριο. Κατά συνέπεια, δεν υιοθετούμε ούτε απορρίπουμε οτιδήποτε.

The long-anticipated battle of Thanasis Nicolaou’s family, seeking justice regarding the circumstances of the tragic death of the 26-year-old national guardsman on 29/09/2005, inevitably brings to light both known and unknown aspects of the case.
The family of the deceased has expressed its intention to file private criminal prosecutions against seven individuals (note: more recent information suggests the number may increase), which are expected to be lodged by the end of next week. This follows the timeframe set by the family’s lawyer, Nikos Klerides, who spoke recently to the Cyprus News Agency.
In its effort to reopen the “Thanasis Nicolaou” file in light of recent developments, Philenews has received information indicating that the upcoming legal battle will not only pit legal circles against one another, but also divide members of the medical profession.
In at least two instances, independent sources pointed us towards the memorandum by forensic pathologist Dr. Andreas Marnerides. At the same time, we were told that his opinion on the cause of death influenced the stance of the Attorney General’s Office during the contentious third coroner’s inquest.
This is a memorandum that was submitted as Exhibit “A” for recognition in the inquest (with the findings issued on 10/5/2024) by the representative of the Attorney General.
Specifically, it was submitted in connection with the request (6/12/2023) by senior public prosecutor Xenia Xenophontos for Dr. Marnerides to give sworn testimony. Ultimately, the coroner, Doria Varoshiotou, rejected this request in her decision on 8/12/2023.
A gap in opinions
The memorandum reveals a gap in opinions among members of the medical profession regarding the cause of Thanasis Nicolaou’s death and is indicative of the defense’s strategy—provided that the private criminal prosecutions are brought, are not suspended, and pass the prima facie stage.
